 1. General Terms

1.1. Acceptance of Terms

By using Teleship’s services (including but not limited to services on teleship.com, services rendered by API and the Teleship apps), you agree to these Terms of Service. Teleship reserves the right to modify these terms at any time without notice. Continued use indicates acceptance of the revised terms.

1.2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use Teleship services. By registering, you confirm that you have the authority to act on behalf of your business.

1.3. Account Creation

To use certain features, you must create an account and provide accurate information. You are responsible for maintaining the security and confidentiality of your account.

1.4. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in England and Wales.

2. Shipping Services and Label Purchases
2.1. Payment Authorization

By purchasing shipping labels, you authorize Teleship to charge your payment method for the costs of the labels, shipping services, and any applicable surcharges.

2.2. Surcharges

If discrepancies arise between declared and actual weights, dimensions, origin and/or destination of good, or other package/content details, Teleship may apply surcharges. Surcharges are based on either actual or dimensional weight, whichever is higher. Teleship may also apply surcharges/penalties for shipping prohibited items.

2.3. Prohibited Items

The following items are prohibited from shipping with Teleship:

  • Agricultural Products (Food, Plants, Animal Products, and Pesticides)

  • Alcohol and Tobacco

  • Chemicals and Hazardous Materials

  • Currencies and Precious Metals

  • Dangerous Goods (e.g., explosives, radioactive materials)

  • Dual Use Products

  • Hazardous Waste

  • Human Remains (including ashes)

  • Ivory, Fur, and Products from Protected Species

  • Live Animals

  • Lithium Batteries of any kind

  • Liquids

  • Narcotics or Controlled Substances

  • Offensive Materials

  • Perishable Goods

  • Pharmaceuticals and Medical Devices

  • Products Included in the Convention on International Trade in Endangered Species (CITES)

  • Weapons and Firearms

  • Licensable Goods subject to import control, permits, and/or approval by governmental agencies, including but not limited to:

    • United States: U.S. Department of Agriculture (USDA), Animal and Plant Health Inspection Service (APHIS), Food Safety and Inspection Service (FSIS), Food and Drug Administration (FDA), Alcohol and Tobacco Tax and Trade Bureau (TTB), Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), Drug Enforcement Administration (DEA), Environmental Protection Agency (EPA), Federal Communications Commission (FCC), U.S. Fish and Wildlife Service (FWS), National Highway Traffic Safety Administration (NHTSA), Consumer Product Safety Commission (CPSC), Bureau of Industry and Security (BIS), Office of Foreign Assets Control (OFAC), Directorate of Defense Trade Controls (DDTC), Federal Trade Commission (FTC), Centers for Disease Control and Prevention (CDC), U.S. Department of Transportation (DOT), and U.S. Department of the Interior.

    • European Union: European Food Safety Authority (EFSA), European Medicines Agency (EMA), European Aviation Safety Agency (EASA), European Agency for Safety and Health at Work (EU-OSHA), European Telecommunications Standards Institute (ETSI), European Fisheries Control Agency (EFCA), National Ministries of Health and Agriculture of each EU member country, European Union Intellectual Property Office (EUIPO), European Environmental Agency (EEA), European Union Agency for Law Enforcement Cooperation (Europol), European Space Agency (ESA), European Union Aviation Safety Agency (EASA), National Telecommunications and Communications Authorities of each EU member country, National Standards Bodies, Directorate-General for Mobility and Transport (DG MOVE), European Union Directorate-General for Maritime Affairs and Fisheries (DG MARE), and European Union Intellectual Property Rights Enforcement Directive (IPRED).

    • United Kingdom: Department for Environment, Food & Rural Affairs (DEFRA), Animal and Plant Health Agency (APHA), Food Standards Agency (FSA), Medicines and Healthcare Products Regulatory Agency (MHRA), Office for Product Safety and Standards (OPSS), Department for International Trade (DIT), Health and Safety Executive (HSE), Environment Agency, Alcohol and Tobacco Unit (HMRC), Home Office, Driver and Vehicle Standards Agency (DVSA), UK Department for Transport (DfT), National Trading Standards (NTS), Office of Communications (Ofcom), UK Intellectual Property Office (IPO), Department for Business and Trade (DBT), UK Ministry of Defence (MOD), Financial Conduct Authority (FCA), Department of Health and Social Care (DHSC), Public Health England (PHE), UK Export Control Joint Unit (ECJU), UK Civil Aviation Authority (CAA), Marine Management Organisation (MMO), Trading Standards Authorities, National Crime Agency (NCA), Civil Nuclear Constabulary (CNC), Forestry Commission, and Intellectual Property Office (IPO).

    • Other Countries: All corresponding national and international agencies.

Teleship reserves the right to reject any shipment that violates these rules and to charge surcharges for costs incurred in reporting and dealing with these authorities.

2.4. Customs Documentation & HS Codes

Merchants are responsible for providing accurate customs documentation, including valid 10-digit HS codes. If not provided, Teleship may generate codes, but merchants remain liable for any customs delays or penalties.

2.5. Shipping Risk

Risk remains with the merchant once the shipment is handed over to third party carriers. Teleship disclaims responsibility for lost, damaged, or delayed shipments unless the merchant has opted into optional insurance (available in the future).

2.6. Returned or Undeliverable Shipments

Merchants are responsible for costs associated with undeliverable or returned shipments, including additional handling fees.

3. Customs, Duties, and Compliance

3.1. Duties and Taxes

Teleship provides estimated duties and taxes at label checkout. However, merchants are responsible for any additional duties, taxes, or customs fees assessed upon importation and delivery.

3.2. Customs Brokers & Third party Carriers

Teleship may appoint customs brokers to handle clearance on behalf of merchants, who authorize this appointment.

3.3. Customs Delays

Teleship is not liable for customs delays or penalties caused by inaccurate documentation or shipment contents.

4. Payments, Disputes, and Refunds

4.1. Payment Terms

Merchants must maintain a valid payment method. Teleship will charge this payment method for all shipping-related services, including any surcharges or additional duties.

4.2. Chargebacks and Disputes

Payment disputes or chargebacks must be raised within 7 days. Teleship reserves the right to suspend services if disputes remain unresolved.

4.3. Refund Policy

Refunds are only issued for services not rendered due to cancellations before dispatch, within three (3) calendar days from label purchase. Once a shipment has been dispatched or in the event that label is not cancelled within three (3) calendar days, the transaction is final.

4.4. Refunds for Optional Services

Refunds are not available for optional services (e.g., insurance) once these services have been rendered.

5. Shipping Risk and Liability

5.1. Risk

The risk of loss or damage transfers to the merchant once the shipment is handed to the carrier. Teleship disclaims responsibility unless insurance has been purchased.

5.2. Insurance

Teleship will offer optional insurance for shipments in the future. Until then, Teleship bears no responsibility for loss, damage, or delays during transit.

5.3. Tracking

Teleship provides tracking information, but merchants are responsible for monitoring shipments. Teleship is not liable for delays caused by incomplete or inaccurate tracking information.

6. Intellectual Property and Licensable Goods

6.1. Licensing & Restrictions

Teleship grants users a limited, non-exclusive, revocable license to use the site for personal or business purposes. Users may not license, sell, rent, modify, reverse-engineer, or exploit Teleship’s site or content. Licensable goods, such as copyrighted works or patented content, cannot be commercially exploited or transferred without appropriate licensing.

6.2. User Content

Users retain ownership of their submitted content but grant Teleship a worldwide, royalty-free license to use and display such content for the purposes of providing services.

7. Service Modifications and Termination

7.1. Service Modifications

Teleship reserves the right to modify or discontinue its services without prior notice. Teleship is not responsible for loss of business resulting from such modifications.

7.2. Termination by Merchant

Merchants may terminate their accounts at any time by providing written notice. Refunds will be processed only for unused services.

7.3. Suspension of Services

Teleship may suspend services for non-payment or misuse. Reactivation fees may apply, and new shipments will not be processed until payment is settled.

8. Data Protection and Privacy

8.1. GDPR Compliance

Teleship complies with GDPR and other relevant data protection laws. Data is processed and retained only for the purposes of service provision.

8.2. Data Sharing

Teleship may share data with third-party partners, such as carriers and customs brokers, to fulfill service requirements. Merchants are responsible for ensuring compliance with applicable data privacy laws.

9. Limitation of Liability

9.1. Liability Limit

Teleship’s liability is limited to the amount paid for its services. Teleship is not liable for indirect, special, or consequential damages, including lost profits or business interruption.

9.2. Customs and Regulatory Compliance

Teleship is not liable for delays, penalties, or fines resulting from customs or regulatory issues caused by the merchant’s non-compliance.

10. Prohibited Activities and Content

10.1. User Conduct

Users must not upload harmful or illegal content to Teleship’s platform. Teleship reserves the right to remove such content and terminate the associated account.

10.2. Prohibited Use of the Site/App

Users are prohibited from unauthorized scraping, hacking, or using automated systems to extract data from the Teleship site/app.

11. Force Majeure

Teleship is not liable for failure to perform or delays caused by circumstances beyond its control, including natural disasters, strikes, or governmental actions.

12. General Provisions

12.1. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in effect.

12.2. Entire Agreement

These Terms constitute the entire agreement between Teleship and the user of service.
